NOTICE TO PASSENGERS:
The Warsaw Convention (as amended from time to time) or the Montreal Convention dated 28 May 1999 and/or the EC Regulation No. 2027/97 as amended by the EC Regulation No. 889/2002 may apply to your journey and govern and may limit the liability of the carriers in respect of death and injury and for the destruction or loss of, or damage to, baggage and for delay.
Your journey is subject to the following conditions.
1. All carriage by air hereunder is subject to the rule and limitations to liability as established by the Warsaw condition and (i) provisions contained in this ticket (ii) applicable tariffs (iii) Carriers condition of carriage and related regulations which are made part thereof. In the carriage of passengers the liability of the carriage for each passenger is limited to a sum being the Sudanese Pound equivalent specified in the current Insurance policy for the aircraft. In the carriage of registered luggage and goods, the liability of the carrier is limited to the Sudanese Pound equivalent to US $ 100.00.
2. Carriers name may be abbreviated in the ticket, the full name and its abbreviation being set forth in carrier’s tariffs, conditions of carriage, regulations or timetables; carriers address shall be the airport of departure; the agreed stopping places shall be those shown on the carriers on the timetable as scheduled stopping places on the passenger’s route.
3. The Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown in case of necessity. Carrier assumes no responsibility for making connections as scheduled.
4. The company is not responsible for any direct or consequential costs resulting from any delays to its services.
5. Passenger shall comply with government travel requirements, present entry, exit, and other required documents and arrive at the airport at a time fixed by the carrier or if no time is fixed, early enough to complete procedures.
6. Carrier reserves the right to refuse carriage and/or cancel the charter for nonpayment of fare or when exercise of its reasonable discretion it decides:
i) That such action is necessary for reasons of safety or reasons of preventing violence or disorder ii) The conduct, age, health, mental or physical state of a passenger is such as to require special assistance of the carrier, or cause discomfort or make him/her objectionable to other passengers or involve any hazard or risk to him/her or to other persons or property. iii) That such action is necessary owing to the failure of a passenger to observe the instructions of the carrier.
7. No agent, servant or representative of the carrier has the authority to alter, modify or waive any provision of this contract.
8. On all services the luggage allowance is 20 kilos. No single piece of baggage will be accepted with a weight greater than 40 kilos. This allowance is inclusive of all hand baggage. The carriage of excess baggage is at the sole discretion of the company after taking into consideration the Aircraft being used and the number of passengers being booked.
9. Smoking will not be permitted on any aircraft.
10. The carriage of animals is at the sole discretion of the company and subject to the company receiving adequate prior notice and the animal travelling in a proper approved airline container supplied by the passenger. Each pet carried must be escorted by an Adult passenger.
11. The contract evidenced hereby or contained herein, shall be governed by the laws of Kenya and any claim arising hereunder shall be determined by the Kenya courts to the exclusion of the courts of any other country.
CANCELATION AND NO SHOW POLICY
Reservations cancelled more than 48 hours prior to departure are 100% refundable within the validity period.
Cancelations of less than 48 hours or after travel date will be penalized at 50% of the charter value Quotes are valid for 30 days. Unless otherwise specified.
